JAMMU: Principal Sessions Judge Poonch Jaffer Hussain Beigh has framed rape charges against two along with main accused, for committing the crime and against two other who provided room but were left out by the investigating agency.
According to prosecution on 9th May, 2014, the prosecutrix, a student, after reaching Surankote from Poonch at about 5:00 PM along with her servant, was waiting for vehicle for her home Galhutta Mendhar but in the meanwhile Taraz Ahmed, driver of a Tata Sumo came and informed her that he too was going towards her home and gave them a lift but when the vehicle reached at Jaranwali Gali, the accused stopped the vehicle on the pretext of going to toilet etc whereafter the accused stopped the vehicle and told her that the vehicle is out of order. It was dark and he forcibly took her and her servant to the house of accused Mohd Rafiq and Zaitoon Begum, the uncle and aunt of the accused in between Phamarnar and Naka Manjhari road and at that time both these accused persons were present at home. Some intoxicated substance was provided to her servant who became unconscious. Taraz Ahmed threatened her with a knife. The accused Mohd Rafiq and Zaitoon Begum put the prosecutrix and Taraz in a separate room and bolted the door where Mohd Taraz raped her. After completion of the investigation offence under sections 376/342 RPC were established against the Mohd Taraz and only offences under Sections 342, 109 RPC were made out against the accused Mohd Rafiq and Zaitoon Begum where after the Challan was preferred before the court. The case after committal was received by this court.
Thus offences under Sections 376, 342, 109 RPC are prima facie made out against both these accused persons. So the charges are accordingly framed against them for the said offences.
Court further observed that the offences committed by the two other accused persons who have on bail not been admitted to bail for offence under section 376 RPC. As such they be sent to District Jail Poonch till next date of hearing. JNF
