STATE TIMES NEWS JAMMU: Justice Sanjeev Kumar of J&K High Court, Jammu in a writ petition WP (C) No 2625/2019 has stayed the One-Time Exemption granted under Government Order No 114 GAD of 2019 dated January 23, 2019, on Wednesday. The Government had accorded sanction to One-Time Exemption regularization for the promotion of Incharge Lecturers (10+2) in education department without referring it to PSC/DPC under Section 133 of the Constitution of Jammu and Kashmir. The petition said that aforesaid Government order is not only illegal but also has been passed in violation of law and rules and even is contrary to the law laid down by the Supreme Court of India in case titled Suraj Parkash Gupta versus State of J&K and others. It is pertinent to mention that government had on several occasions issued promotion orders to give benefit to blue-eyed and when the PSC declines to accord regularisation, the PSC rules are sidelined and all such promotions are regularised under the garb of ‘one time exemption’. “The ‘one time exemption’ rider has been exercised by the government number of times earlier where PSC had declined to regularize all the incharge lecturers (10+2) and now again in January this year the same violation has been repeated. These promotees are otherwise supposed to be regularised by PSC after fulfilling the eligibility criterion. Applying ‘one time exemption’ concession has almost put the promotions in the Education Department on sale”, the sources alleged.
