STATE TIMES NEWS JAMMU: Justice Vinod Chatterjee Koul of J&K High Court on Saturday directed Addl. Dy. Commissioner Bhadarwah to submit the action taken report on the complaints, representations and court order passed in the case wherein petitioner Raghbir Singh Kotwal has sought directions for the revenue department to remove truss and iron poles dumped near his house. Appearing for the petitioner, A.K Sawhney Advocate highlighted the inactions of the Govt. officials, who did not perform the statutory functions. The revenue contents of the petition reads, “The petitioner no. 1 on June 24, 2020 moved an application to the respondent no. 4 with the request for directing removal of Truss along with Iron Poles and implementation of Order dated April 29, 2020 and May 11, 2020 through police and for initiating contempt proceedings or legal proceedings under Section 188 IPC. On June 25, 2020 the Addl. DC Bhadarwah (Revenue Court under Land Revenue Act and Agrarian Reforms Act) issued a communication to the respondent no. 5 (Tehsildar Bhadarwah) and observed that despite orders, the status report was not filed by respondent no. 5 and the applicant / petitioner had approached the Addl. DC with photographs of the spot wherein it was alleged that after dumping of material, the respondent no. 9 has not fixed iron poles and trusses (GI sheets) around the land of the petitioners and he is taking benefits of the lockdown and bent upon to raise construction on spot”. The Tehsildar was directed to visit the spot personally along with SHO police station Bhadarwah and restrain the respondent no. 9 (non applicants) from interfering into the suit property of petitioner. Meanwhile, it was directed that the dumping of the material be removed from the spot.
