STATE TIMES NEWS JAMMU: Principal Sessions Judge Reasi Kamlesh Pandita on Friday rejected the bail application of four alleged accused namely Fareed Ahmed, Bashir Ahmed, Gulam Quadir and Abdul Qayoom allegedly involved in case of minor’s kidnapping and rape. According to the police, petitioners/accused persons were involved in case under FIR 41/2019, Police Station, Chassana, for the commission of offences under Sections 452, 363, 376(D), 354 and 343 RPC read with Section 4 of Prevention of Children from Sexual Offences (POCSO) Act. After hearing both the sides, the court observed that in the case two accused persons are absconding against whom proceedings under Section 512 Cr.PC are in progress and charges are yet to be framed. “There is also no change in the circumstances under which the earlier bail application of the accused persons/applicants herein was rejected. Therefore, without discussing further merits of the case in this bail application, I am not convinced to exercise any discretion in favour of the accused persons/applicants herein in view of the statutory bar under Section 32 of the POCSO Act and also due to the gravity of the offence as well as in the interest of justice. Any sexual assault on a minor girl child is termed as most heinous and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospects of the victim. The new legislation has been enacted with an object to deal with an iron fist on the offenders due to the ever increasing intensity of incidents of sexual violence against the children/minors. It is also duty upon the courts to fill the link with the objectives of the new legislation called POCSO therefore, in the facts and circumstances of the case and in view of the above detailed reasons, the bail application filed by the accused persons is out rightly rejected”, Principal Sessions Judge Reasi Kamlesh Pandita observed.
