Pleads for more circuit benches for delivery of justice at door steps
STATE TIMES NEWS JAMMU: Welcoming the conceding of much deserving and most justified demand of setting up of separate CAT bench for Jammu, Kashmir and Ladakh, JK Pradesh Congress committee however said that the BJP government takes the people here, for granted, as it tries to rectify several unmindful decisions, only after lot of by hue and cry by the people. Reacting to the decision to have separate CAT bench for J and K and Ladakh UTs, JK Pradesh Congress chief Spokesperson Ravinder Sharma said that this should have been done after the J and K re organization act came into effect and at least much before the order for transfer of thousands of pending cases to the Chandigarh Bench of CAT. This was known to happen after the action of August 5, last year but no steps were initiated for its creation and establishment all these months and suddenly an order was issued transferring all pending cases and for filing fresh cases before Chandigarh bench. It was only after lot of protests by various concerned quarters especially lawyers and others, over the unreasonable decision who approached the high court and Supreme Court too and the letter of Chief Justice of JK high Court to the GOI, that the govt was left with no option but to set up separate bench for J and K and Ladakh UTs. There is something seriously wrong in the the process of decision making of the government and there appears lack of due care and thought process while dealing with issues of great public importance, which result in the large scale unrest and avoidable chaos and confusion amongst stake holders over various actions of the govt. He said govt has to resort to u turns and course corrections in various matters, as it does not take necessary consultative feedback about most issues of greater public concerns. He said still there is doubt amongst people about the position of the bench in Kashmir and Ladakh and there should be every effort to provide justice to the people at door steps, by having more circuits benches for far flung areas like Rajouri-Poonch and erstwhile Doda district and other such similar belts. The govt should consider this in consultation with legal fraternity for future dispensation. The govt also did not take the legal fraternity on board while deciding about transfer of power of registrations from judicial officers to revenue authorities and imposed its decision despite protests by various quarters as a result the common man is going to suffer a lot for all times to come. There was lot of unrest over the domicile law which was modified within two days, to some extent after strong backlash but still there are strong reactions and reservations over the Amended domicile law also. It only proves how far away the govt is, especially the BJP, today, from the sentiments and needs of the people, either due to arrogance or ignorance, he added.
