STATE TIMES NEWS JAMMU: Sub-Judge Jammu Pawan Kumar Sharma rejected bail application of a person allegedly involved in car theft case. According to the police case, Vandana Chib lodged a police report on January 10, 2019 that she had parked her car in the market and when she came back she found her car was stolen. The vehicle was registered in the name of her father. Subsequently, police registered FIR No. 21/2019 for offence under Section 379 RPC and during investigation the applicant/accused was arrested. After hearing Senior Prosecuting Officer Puja Nijhon for the State, the court observed that after perusing the report it has not become clear that when the accused was arrested so the claim of the applicant that he has been in police custody for the last nine days is found false. “The accused has not only stolen the vehicle of the complainant who happens to her neighbourer but he has also shattered the faith of the complainant. The fact that firstly keys were stolen and then the vehicle, shows that how preplanned the whole act was committed by the accused. The fact that the vehicle is involved in other case and has been recovered by Police Station, Rajbagh Kathua in offence under Section 3/25 Arms Act also shows the design and intention of the applicant/accused. Also there has been allegation against the accused about his involvement in some other cases of similar nature which shows that accused is a habitual offender”, the court observed and added, “The fact that vehicle has been recovered in another case at Kathua District shows that how the applicant after committing theft of vehicle has sold it to some anti social elements where a case under Section 3/25 Arms Act stands registered. The court also observed that since the sequence of crime is yet to be exposed in the present case and the consideration that the owner of the car has gone bereft of the vehicle is also to be seen while considering the bail application. With these observations, the court rejected the bail application.
