Execution of forged lease of 600 kanals State Land

JAMMU: The State Vigilance Organisation (SVO) on Tuesday booked former Assistant Commissioner Revenue (ACR) Jammu, other revenue officials, Shashi Khajuria, Secretary Dharmarth Trust Council and other members of the trust besides beneficiaries involved in executing a forged lease of 600 kanals State Land situated at village Junakha near Nandni Tunnel, in Tehsil Dhansal of District Jammu.
Raids conducted in Jammu, Rajouri
Simultaneous raids were conducted in the houses of these accused in Jammu and Rajouri, leading to recovery of various incriminating documents. The SVO has registered FIR 35/17 under Sections 5(1) (d) read with 5(2) J&K PC Act 2006 Bk, and 467, 468, 471 and 120-B RPC.
The SVO verification revealed that the Government of J&K had allotted 600 kanals State Land in favour of Rani Sahiba, wife of Late Ram Singh with the conditions that the land should not be used for construction, cutting of trees, grazing of cattle, etc.
The status of the property was “State Land”. It was also revealed that the land in question was under the ownership of “Sri Sarkar Doulatmand” with the name of “Deudi Mabarak Sri Raja Sahib Bahadur Ram Singh Sahib Soragwasi” mentioned as cultivator.
The land comprised of “Talab, Gair Mumkin Abadi, Jharh and Bagicha” etc, remained in the illegal possession of different parties including Jagdeep Singh, son of Saroop Singh and Dharmarth Trust and others at different point of time.
However, at present the land in question was under the descendants of illegal possession of Late Jagdeep Singh. Under a well net conspiracy Shashi Khajuria, Secretary, Dharmarth Trust Council filed a suit in the office of ACR Jammu against descendants of Jagdeep Singh, son of Saroop Singh and others for cancelling their Girdwaris and entering the name of Dharmarth Trust in the ownership and Girdwari Column in their place.
During the pendency of the case, both the parties have been shown to have entered in the compromise in favour of the Dharmarth Trust. Since the descendants of Late Jagdeep Singh were already illegal occupants therefore, had no claim over the property, neither any compromise was admissible because of aforesaid chunk of land was the State Land.
In the garb of above mentioned suit, an unrealistic Sehat Kashat mutation was entered in the revenue records and Dharmarth Trust was shown as the legal occupant of the State Land in question. The accused ACR summoned the concerned Patwari in his office and made him to sign the copy of record (Record of Rights) already prepared by an official posted in the office of ACR Jammu.
The report mentioned was prepared for perusal and handed over to one Ranjeev Gupta, one of the lease holders. Thereafter, some insertions were made in the aforesaid report whereby Dharmarth Trust has been shown absolute owner and legal occupant of this land.
The Dharmarth Trust used the same forged report and leased out the land in question to private businessmen (beneficiaries) including Ranjeev Gupta, son of Chajju Ram Gupta, resident of 149, Garden Avenue, Talab Tillo Jammu, Chetan Nagpal, son of Late Davinder Nagpal, Nitan Nagpal and Ritin Nagpal, sons of Late Kewel Nagpal, Sahil Nagpal, son of Late Pardeep Nagpal, and Sanjeev Nagpal and Rajan Nagpal, sons of Sita Ram Nagpal, residents of Gandhi Nagar Jammu.
The lease was registered in the Court of Sub-Judge Jammu for Rs. 2.90 crore and has changed hands in the transaction for transfer of Government property.
In view of the lease deed, the lease holder has been authorized to use the land in question whereas the Government Order whereby the then Rani Sahiba was permitted to use the land was conditional by restricting the use of land for construction/cutting of trees, grazing of cattle, etc.
The accused persons managed to register the lease on the basis of forged Revenue report under suspicious manner as the nature of the land does not allow such commercial activity on the aforesaid land.
Today after the registration of FIR, the SVO teams conducted searches in the houses of former ACR and other accused including the beneficiaries.
The conspiracy hatched by the then ACR Jammu and other revenue officials in league with private persons namely Shashi Khajuria, Secretary and other members of the Dharmarth Trust Council and beneficiaries Ranjeev Gupta, son of Chajju Ram Gupta, resident of 149, Garden Avenue, Talab Tillo Jammu,Chetan Nagpal, son of Lt. Sh. Davinder Nagpal, Nitan Nagpal, Ritin Nagpal, both sons of Lt. Sh. Kewel Nagpal, Sahil Nagpal, son of Lt. Sh. Pardeep Nagpal, Sanjeev Nagpal and Rajan Nagpal, all sons of Lt. Sh. Sita Ram Nagpal, resident of Gandhi Nagar Jammu constitute the commission of offences punishable under section 5(1) (d) r/w 5(2) J&K PC Act 2006 Bk, 467, 468, 471 and 120-B RPC. Accordingly, the case was registered and investigations set in motion.
