JAMMU: Principal Sessions Judge Jammu Vinod Chatterji Koul on Thursday awarded two years imprisonment to Asma Fayaz Bhat, daughter of Mohammad Iqbal, wife of Abdul Salam Bhat alias Fiaz Bhat, resident of House No.SK 14/37 B, Khijrabad, Post Office Kandi,Tehsil and District Karachi, Pakistan.
After hearing Public Prosecutor Rakesh Badyal for the State, the court observed that as per the evidence on record and also the statement of Asma Bhat recorded under Section 342 Cr.P.C, the prosecution has succeeded in establishing the charge i.e. commission of offence punishable under Section 14-A Foreigners (Amendment) Act, 2004 against Asma Bhat and accordingly she is convicted for the commission of offence punishable under section 14-A Foreigners (Amendment) Act, 2004. 29.
The court further observed that the accused is a foreign (Pak) national, who had entered into Indian Territory without any valid permit and was found in restricted area/protected area, thus, violated the provision of Section 14-A of Foreign (Amendment) Act, 2004.
The accused is a young lady of 39 years therefore, having regard to the circumstances of the case and her age, she is sentenced to undergo imprisonment for a period of two years and shall also be liable to pay a fine of Rs. 10,000 and in case of her default to pay the fine, she shall further undergo imprisonment for a period of three months. Court further said that after completion of sentence necessary steps should be taken for her deportation.
