In this twilight hour when the nation seems to be all geared up for undertaking radical reforms in the pluralistic Indian society through consensus and judicial review coupled with proper legal process, sensitive issue of triple Talaq prevalent in predominant Muslim community is subjudice in the Supreme Court. The Govt. has already made their stand clear in the Court by opposing the continuation of the practice in its current form as it is ultra vires of Indian Constitution and replete with adverse fall out subjecting huge segment of fair sex of a particular community to innumerable trials and tribulations in comparison to the womenfolk of all other communities in the same country in the name of religion. However, the All India Muslim Personal Law Board have filed dissenting response out of sheer highhandedness, asserting that practice of triple Talaq is part of their religion as such adjudication and judgment of Apex Court is undesirable.
Constitution of the country provides for equality before law for all citizens irrespective of their sex, colour and creed. It also ensures religious freedom to all communities to pursue their religious practices as per their belief, system evolved over the years under the umbrella of national Constitution which is the guide book for governance. All religions stand for truthfulness, mutual trust, brotherhood, love, peace and universal harmony. All beliefs and practices are acceptable until and unless they do not cause discomfort, pain and misery to followers of the religion. Barring the divine commandments and basic tenets of religion, the rest of every practice and belief is subject to amendments. The unbridled practice of triple Talaq has created havoc in the sacred family system of Muslim brothers and sisters. It deeply hurts the women and makes their life miserable. It is also affecting their progeny. This has ultimately stimulated the enlightened women to rise in revolt against the inhuman practice of triple Talaq and seek justice from highest Court of Law. The nation stands for justice for all and the appeasement of none.
