JAMMU: Justice Sanjay Kumar Gupta of State High Court on Saturday held that mere fact that petitioner was short-listed does not confer any right to selection.
The court gave this observation while dismissing the petition challenging the select list of the candidates for the post of Pharmacists District Cadre Udhampur. After hearing Deputy Advocate Generals Sanjeev Padha and Raman Sharma for the State, the court observed that petitioner has participated in selection process with definite knowledge about methodology to be adopted by official respondents for selection of posts of Pharmacists vide Advertisement No. 6 of 2004 dated September 29, 2004. “He could not succeed and now he is stopped from challenging the selection process. Had he been selected, he could not have challenged the same. Mere fact that petitioner was short-listed does not confer any right to selection”, the court observed. With these observations High Court dismissed the petition challenging the selection list.
