PATHANKOT: A Supreme Court Bench, headed by Chief Justice Deepak Mishra, will hear on Monday the case with regard to relief sought by an accused, inter allia, for CBI probe into the Rassana Rape and Murder Case.
The case had been transferred by the apex court from Kathua to District and Sessions Court, Pathankot on 7th May 2018.
The counsel for the accused, A.K Sawhney told STATE TIMES that his client, Tilak Raj has been dismissed from services without enquiry or serving a show cause notice and so much so he has not been given copy of termination. He said the accused is under financial constraint to defend his counter prayer for CBI probe in the Supreme Court, as even his sustenance allowance has been stopped by passing termination order without any notice. Due to shortage of money, the poor man cannot afford to contest the matter in the Supreme Court, he submitted.
Meanwhile, Advocate Sawhney told that it was established during the cross examination of the witness Mohd Yousaf that the deceased minor was not his daughter. However, since filing of FIR till recording of the statement in the Court he was falsely making statement that he was father of the girl, Sawhney said, adding that he did not even know the date of birth or place of birth of the deceased and in fact happened to be uncle of the deceased.
“It was further admitted by the witness that money is being collected in the name of the minor girl and some Trust or Foundation is collecting lakhs of rupees on the name of the deceased which is being used by him in collaboration with one Trust known as Rehber Foundation Trust to get donations”.
The witness has admitted that one Talib Hussain, who happened to be the mastermind behind creating tense situation amongst the communities was guiding for road blocks and protests. He said Talib Hussain has a major role in collecting money in the name of the aforesaid minor deceased.
He also admitted that he has a PAN number and on the donations the Income Tax exemptions are being given to the donors.
Mohd Yousaf admitted in the Court that only Rs 1 lakh has been paid to him. He feigned ignorance about the amount collected so far. However, he said his J&K Bank account is being used for collecting the funds.
In a shocking revelation, witness Mohd. Yousaf had got all his five children admitted in school but for the deceased child, who had been kept for grazing horses and attending to other domestic chores as a maid servant, said Sawhney.
It may be mentioned that Talib Hussain, against whom there are attempt to murder cases and a case of harassing his own wife and deserting his daughters, was the kingpin in framing the accused persons. He has also been instrumental in arranging the meetings of Mohammad Yousaf and other with ministers and even the Chief Minister. He has also been inciting and instigating them to block the national highway and commit breach of peace, resulting in flare up of communal passions.
