JAMMU: The Chief Justice of J&K High Court Justice Gita Mittal on Thursday treated a petition filed by RTI activist Balvinder Singh as a Public Interest Litigation (PIL) wherein the petitioner has sought directions to the J&K High Court Bar Association Jammu not to collect parking charges from the litigants and general public for the parking slots at High Court Complex and subordinate courts complex at Jammu.
In the petition it has been divulged that the Registrar Judicial High Court Wing Jammu in response to an RTI application has confirmed that J&K High Court Bar Association Jammu is collecting the parking charges illegally without any authority or orders of competent authority and the aforesaid officer has informed the Registrar General J&K High Court to inform the higher authorities of the High Court to take appropriate action in the matter.
The petition states that the entire Court Complex is a property of State High Court and Bar Association being a welfare association of lawyers has no domain/function to collect the parking charges from the litigants and general public.
The petition further states that money in lakhs is being collected every month by the private persons being hired by association and this whole process is illegal as the Complex belongs to the High Court and the association has no right to outsource the Court property. Further the association is also collecting rent from stamp vendors, typists, canteen owners, fruit corners and others when such activities are required to be regulated by the High Court itself or the Government Departments who are responsible for the development and maintenance of the complex.
The petition filed by Balwinder Singh in person seeks to take appropriate action against the private persons hired by Bar association for collecting the parking charges illegally and without any authority both at High Court as well as in the District Courts Complex, Jammu.
The association must produce before the Court the entire statement of accounts regarding the collection of parking charges ever since it has started collecting the parking charges from the litigants and general public, states the petition.
The petition further sought to forthwith stop the illegal collection of parking charges from the litigants and general public as it has been confirmed that the parking charges are being collected illegally without any authority of law.
