JAMMU: In a significant order, the Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Tashi Rabstan directed the personal appearance of Director Land Management (DLM) JDA and Additional Deputy Commissioners (ADCs) Jammu and Samba in the much publicised Public Interest Litigation (PIL) highlighting encroachment of more than 20 lakh kanals of State Land by the land Mafia in the state of J&K to understand the magnitude of the problem relating to non-demarcation of JDA land measuring 66,436 kanals and one Marla.
The Division Bench directed the listing of the matter on 11th April 2017.
After hearing Advocate Sheikh Shakeel Ahmed with Advocate Irfan Mohammad Khan appearing for the petitioners, Advocate R.S Jamwal for the intervener, Senior AAGs S.S Nanda, Seema Khajooria Shekhar, Deputy Advocate General Ehsan Mirza, Advocate Sudesh Magotra appearing for the State Government, Advocate Adarsh Sharma appearing for JDA whereas Senior Advocates M.A Goni, Sunil Sethi with Advocates Mumtaz Chowdhary and Sumit Nayyar and Advocates A.M Malik and Raghav Kumar appearing for the private respondents/aggrieved encroachers, the Division Bench also directed Deputy Advocate General Ehsan Mirza to comply the directions passed on the last date of hearing viz 22nd February 2017 whereby the Divisional Commissioners of Jammu and Kashmir, and all other concerned officers were asked to file the status reports indicating the persons against whom eviction proceedings have been commenced and status thereof in each case.
The Division Bench also directed that since the State Counsel has submitted that the record would be voluminous as such permission is granted to file the digital copy of the same through DVD/Pen-drive and copies of the same may also be given to Advocate Sheikh Shakeel Ahmed and Advocate R.S Jamwal appearing for the petitioners. The Division Bench allowed three weeks time to Deputy Advocate General Ehsan Mirza to do the needful.
Advocate S.S Ahmed apprised the Division Bench towards the order dated 12th November, 2014 wherein the issue of the encroachment of JDA land was highlighted.
Advocate Ahmed submitted that under various orders 86,941 kanals of land was transferred to JDA by the State Government and out of this only 19,391 kanals and 11 marlas have been demarcated and the remaining area measuring 66,436 kanals and one marla has not been demarcated yet.
