STATE TIMES NEWS UDHAMPUR: A.K Sawhney, Advocate, former President of the J&K High Court Bar Association Jammu on Saturday visited Bar Association Udhampur in connection with his first hand interaction with members of JKHCBA Jammu at Udhampur and sister Bar Associations. Sawhney presented a ‘memento’ as a token of respect and gratitude to President Bar Association Udhampur J.D Slathia Advocate. All the Bar members and executive of the Udhampur accepted the memento as a token of respect from A.K Sawhney Advocate, former Bar President of JKHCBA. A.K Sawhney Advocate while addressing the members of the Bar Association of Udhampur highlighted the problems being faced by the lawyers at Jammu, Udhampur, Kathua, Samba, Akhnoor, R.S. Pura etc. etc. A.K. Sawhney demanded stipend for the new advocates upto five years to the tune of Rs, 10,000 (Rs.Ten thousand), medicare facilities, permanent disability financial assistance to advocates, pension benefit schemes for advocates. He said all these schemes and benevolent funds would be possible once the elections of J&K State Bar Council are held and a statutory body takes birth which would be governed by advocates only, said Sawhney. The Advocate Welfare Act which is only in papers in J&K will be implemented in letter and sprit by the elected Bar Council. Sawhney criticised the constitution of a disciplinary committee constituted under Bar Council Rules of the High Court Judges and demanded to abolish such Committees which do not exist anywhere in the country except in our state due to lack of elected Bar Council. He assured all members of legal fraternity that a vote cast in his favour would be a vote of referendum for the early elections to the State Bar Council. He exhorted he advocates that those who want the disciplinary committee of Judges let them vote against me and all those who feel and want that it is an illegal act and misuse of the powers by the High Court, then they must vote for Sawhney. All those candidates who are opposing the constitution of the State Bar Council are opposing the Supreme Court judgment passed in Prof Bhim Singh’s case where it is has been directed to hold the J&K Bar Council elections within four months but despite lapse of more than one year the Elections of State Bar Council are not being conducted. A.K Sawhney said this JKHCBA 2019 election is going to be historical and decisive on the subject once for all. “I will fight tooth and nail and leave no stone unturned to get Elections of State Bar Council and abolition of Disciplinary Committee comprising of judges. He said his main object to contest the Bar Association Election is to get elections of State Bar Council conducted. He further shared with the audience that after a year he resigned from the post of Munsiff and accepted the challenge of law practise and how he faced ups and downs in life. He said the only mission of his life which is unfinished is to see an elected Bar Council in J&K and for which he is contesting the elections to pursue his struggle for an elected Bar Council of J&K. He explained how the Bar Council would function and also have its members in the Bar Council of India. He said that where there are elections for the Parliament, Assembly and even local bodies there from 1961 the elections to the Bar Council have not been held despite Supreme Court’s orders. He assured that in case he is voted as President of the Bar Association Jammu for which the elections are due from quite a time now, he shall restore the glory of the Bar and leave no stone unturned for the dignity of the lawyers. He also put light on the problems of the young lawyers like corruption in lower rung, work problems, stress, arrogance of the presiding officers and lack of library, computers and basic amenities and dignified sitting arrangements etc A.K Sawhney said that if Bar members elect me as their President he will maintain its independence, integrity and will not be subordinate to Bench or any other authority or institution. He further said that Bar accounts and funds would be properly audited by prominent C.A. and copy of the same shall be made available on Bar Website. Bar website to be built and developed as dynamic cyber property and bar rooms in Distt Courts and High Court complex including Bar rooms, ladies bar rooms to be made Wi-Fi free zones for members.
