JAMMU: Justice Janak Raj Kotwal on Monday while observing that how the Forest Guard has been posted against the higher post of Block Officer stayed the impugned order and issued notice to the respondent.
The court direction came in a petition filed by Ishtiaq Ahmed Mir, Forester challenging the transfer of one Forest Guard on the senior post as Block Officer.
Advocate Zahir Sarfraz Malik appeared for the petitioners.
According to the petition, respondent in order to accommodate one of his blue-eyed namely Haji Nissar Hussain, who is simply a Forest Guard passed the order impugned vide no. 20 of 2017 dated September 6, 2017 transferred the petitioner and adjusted Haji Nissar Hussain two steps ahead as Block Forest Officer Thannamandi. “The transfer of the petitioner has been done to accommodate Hajji Nissar Hussain, a Forest Guard as Block Forest Officer in place of petitioner, who in way is competent rather qualified to hold the post, which clearly shows that the transfer of petitioner has not been done in the interest of administration or in public interest but with malafide intentions to adjust the blue-eyed on a post for which he is not eligible”, it added.
