JAMMU: High Court (HC) on Saturday stayed the FIR concerning a theft case registered at Police Station Kandi District Rajouri.
The court order came to in a petition filed for quashment of FIR under Sections 379, 147 and 447 RPC by Mohammad Sadiq and his brother Mohammad Rashid, registered on the written complaint of one Abdul Aziz, son of Jahan Mohammad of Koteranka.
Appearing for the petition, Advocate Mohammad Latif Malik submitted that petitioners have been falsely implicated by the Police in connivance with the complainant for the reasons that the petitioners and complainant are in civil and criminal litigation and the land in question is in the possession of the petitioners. “The FIR has been registered to mount pressure on the petitioners to grab the land in question”, he submitted. Upon this, Justice M.K. Hanjura of State High Court ordered that subject to objections from other side and till next date of listing of the case before the Bench, the operation of FIR No. 95/2017 registered at Police Station Kandi, Rajouri for the commission of offences punishable under aforesaid Sections shall stay and directed that the case be listed on March 20, 2018.
