JAMMU: Justice Sanjay Kumar Gupta of State High Court on Tuesday dismissed the petition filed by Khaliq Hussain Shah seeking quashment of FIR No. 48/2014 dated June 27, 2014 registered at Police Station Gursai, Poonch under Section 376 RPC.
Justice Gupta after hearing Government Advocate Sanjeev Padha for the State, dismissed the petition with the observations that from the perusal of allegation leveled in complaint and the status report filed by the State, it is evident that cognizable offence is made out against the petitioner, which requires thorough investigation. The grounds mentioned in the petition cannot be considered at this stage to quash the aforesaid FIR registered at Police Station Gursai, Poonch under Section 376 RPC.
