JAMMU: Justice M.K Hanjura of State High Court on Monday quashed the First Information Report (FIR) filed against the then Executive Officer Ravi Kumar registered by Police Station Vigilance Organisation Jammu (VOJ) vide No. 21/2017.
The court direction came in petition filed for quashing the aforesaid FIR lodged by Police Station Vigilance Organisation Jammu.
Justice Hanjura after hearing Advocate A.P Singh for the petitioner observed that this case falls within the purview and under the category of cases where the FIR does not disclose any offence even as the allegations contained in it are taken to be true at their face value, for the simple reason that the petitioner was not posted at Udhampur when the construction in question commenced.
Taking into consideration the aforesaid observations, the court held that aforesaid FIR registered against the petitioner for the commission of an offence under Section 5(1) (d) read with Section 5 (2) J&K Prevention of Corruption Act and Section 120-B RPC and all other proceedings there-from are liable to be quashed and are accordingly quashed.
