STATE TIMES NEWS JAMMU: Justice Dhiraj Singh Thakur of State High Court on Monday admitted a petition filed by a State subject holder woman namely Prof Renu Nanda married outside the State and later divorced seeking Permanent Resident Certificates (PRCs) for her children. After hearing Advocate Ankur Sharma appearing for the petition, the court issued notices and directed respondents to file counter affidavit within two weeks. The notices were accepted by Senior Additional Advocate General (Sr AAG) S.S Nanda. The counsel for the petitioner submitted that a discretionary power as in the present case where the children of a divorced woman permanent resident of Jammu and Kashmir are not being granted the PRC is illegal and arbitrary. He submitted that Prof Renu Nanda is the mother of Keshav Kumar and Madhav Kumar and the petitioner through the instant petition is seeking relief for such injury caused or likely to be caused to the petitioner in the State of Jammu and Kashmir on account of non-issuance of PRC to the children owing to arbitrary ground that children have applied for the grant of PRC on the basis PRC issued to their mother i.e. Renu Nanda thereby encroaching upon their fundamental rights guaranteed under Articles 14, 19 and 21 of the Constitution of India. “Consequentially all fundamental rights in the State of Jammu and Kashmir have been left redundant, otiose and subject to arbitrary exercise of authority to the extent of children”, the petitioner stated.
The father of aforesaid children was a non state subject and Keshav Kumar and Madhav Kumar who were minors at the time of divorce of their parents remained in the exclusive custody of their mother in J&K only. It is further submitted that Renu Nanda is serving in the University of Jammu as Professor in the Department of Education and both the parents of Renu Nanda were state subject holders.
