JAMMU: The Principal District Judge, Jammu Vinod Chatterji Koul after hearing the appeal filed by Reeta Anadi & Others against the judgement dated March 16, 2011 passed by 3rd Additional Munsiff, Jammu in a suit titled “Dr. V.K. Pachnanda v/s Reeta Anadi & Ors” upheld the decree of the Trial Court on the ground of personal necessity.
While delivering the landmark judgement, the Principal District Judge Jammu held that Roopa Pachnanda has succeeded in establishing the genuine need of the suit premises.
The other connected appeal filed by Roopa Pachnanda on the ground of default in payment of arrears of rent by the tenants Rita Anandi and others has been decided in favour of appellant Roopa Pachnanda.
Advocate R K Jain appeared on the behalf of Roopa Pachnanda in both the appeals and Advocate Amit Bhardwaj appeared for Reeta Anadi and others.
The Principal District Judge, Jammu while deciding both the appeals allowed the appeal of Roopa Pachnanda on the ground of default in payment of rent and dismissed the appeal of Reeta Anadi and others, as filed against the decree dated 16th March, 2011, on the ground of personal necessity.
More than two decades litigation pending in Court was originally filed by renowned Dr. V.K. Pachnanda for establishing a Charitable Nursing Home ultimately attained its finality after the judgement of the Principal District Judge, Jammu.
Even after the demise of Dr. V.K. Pachnanda, his wife Roopa Pachnanda in order to achieve the desire of her late husband to setup charitable Orthopedics clinic and also for augmentation of income, all along contested the litigation through her counsel R K Jain vigorously and finally succeeded.
