JAMMU: A Division Bench (DB) of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Dhiraj Singh Thakur on Monday stayed Writ Court’s verdict quashing premature retirement of Bumesh Sharma, the then Programme Officer ICDS Project Samba.
The court order came in a Letter Patents Appeal (LPA) filed by the State against the judgment of Writ Court whereby it has quashed the order of compulsory retirement of aforesaid official with the observations that the order of compulsory retirement cannot be passed as shortcut to avoid the departmental inquiry, when such course is more desirable.
Advocate General Jahangir Iqbal Ganai with Additional Advocate General Rohit Kapoor appeared for the State while Senior Advocate Z.A Shah with Advocate Vipin Gandotra represented the respondent.
The DB while fixing the next date of hearing on February 26, 2018 ordered that in the meanwhile, there shall be stay of operation of the aforesaid impugned judgment.
