JAMMU: A Division Bench (DB) of State High Court comprising Justice Tashi Rabtsan and Justice M.K Hanjura on Friday granted last and final four weeks’ time to comply with the directions in a contempt petition filed against non-implementation of Gair Mumkin Khad verdict and non-framing of water policy, failing which the Chief Secretary shall appear in person on the next date of hearing.
Advocate A.K Sawhney with Advocate Aseem Sawhney appeared for the petitioner while Senior AAG S.S Nanda appeared for the State.
Counsel for the petitioner submitted that DB had directed the respondents to frame the water policy within two months in February 2016 in a Public Interest Litigation (PIL) and directed status quo with regard to Gair Mumkin Khad lands but despite lapse of more than a year, the respondents are sleeping over the matter and have failed to comply with the directions on one excuse or the other. He further submitted that it is sheer slackness and red-tapism due to which the Court directions are not being implemented and the Court is being hoodwinked by the respondents.
Division Bench after hearing both the sides observed that affidavit in terms of order dated August 25, 2017 has been filed by Chief Secretary, J&K Government, contending therein that it was decided in the meeting convened on September 19, 2017 attended by Administrative Secretaries of the concerned Departments, such as Power Development, Housing and Urban Development, Industries and Commerce, Animal/Sheep Husbandry, PHE/Irrigation and Flood Control and Forest, that above mentioned departments will furnish their comments in light of discussions held in the meeting, within a period of one week positively. It is further contended that on receipt of comments, same will be placed before Cabinet Sub Committee in its next meeting for consideration.
Upon this Division Bench granted last and final opportunity to comply with the directions.
