JAMMU: A Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar on Wednesday observed that playgrounds will be used only for the purpose they have been earmarked, namely, for sporting activities however as far as order dated November 11, 2014 in WPPIL No. 20/2014 is concerned, it was clarified that the permission that is to be accorded by the Court for using any of the playgrounds for any purpose other than one pertaining to sports would only relate to Independence Day or Republic Day celebrations.
The court directions came in a PIL seeking that playgrounds should not be used for any other purpose except sport activities.
“If the playground is to be used for any purpose other than the one pertaining to sports, prior permission from this Court shall be obtained. If there is any violation of the directions issued in aforesaid PIL No. 807/1998, decided on May 8, 2002, the same shall be considered as Contempt of Court and appropriate proceedings shall be initiated,” the court observed adding that the playgrounds can be requisitioned for emergency services in the event of floods, earthquakes and other natural calamities. “This order shall apply to all designated playgrounds”, the court observed.
