JAMMU: A Division Bench of State High Court comprising Justice Tashi Rabstan and Justice M.K Hanjura in a contempt petition filed by AV Gupta in PIL regarding direction to the State to provide basic health facilities for treatment of cancer in the State of Jammu and Kashmir and also to provide adequate number of oncologists, Onco-surgeons, PET scan machines and all other experts in the relevant field for the treatment of various types of cancer in all the regions of the State observed that as per earlier order Dr. Pawan Kotwal, Principal Secretary to Government, Health and Medical Education Department, is present in person, who has also filed affidavit in pursuance to directions issued by this Court vide order dated September 7, 2017.
Advocates Aditya Gupta and Ajay Sharma appeared for the State. The court also observed that Dr. Pawan Kotwal has apprised that the State Government has already approached the Government of India for release of funds and posts referred to the Public Services Commission (PSC) on March 16, 2011 are still unfilled.
Upon this, the Division Bench observed that in order to ascertain the present status, it is appropriate to array Secretary, PSC as party respondent. Accordingly, court arrayed Secretary, PSC as party respondent and issued notice to PSC through its Secretary which was accepted by Advocate F.A Natnoo.
DB directed counsel for the PSC to file report in reference to letter dated March 16, 2011 addressed to Secretary, PSC by State Government with regard to the filling up of the posts of Oncologists in Government Medical College Jammu in terms of directions issued by this Court vide judgment dated February 17, 2016.
