JAMMU: A Division Bench of State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Alok Aradhe modified the order of Writ Court (WC) whereby the match of Col. C.K Nayudu Tournament (U-23) was stopped midway and allowed the J&K team to participate in tournament besides directing BCCI to reschedule the match between J&K and Goa which was cancelled on October 8, 2017 in between due to order passed by Singe Judge.
The court directions came in a Letters Patent Appeal (LPA) filed by Board of Control for Cricket in India (BCCI) against the aforesaid order of Writ Court
Senior Advocate Sunil Sethi with Advocate Parimoksh Seth appeared for the BCCI.
In the LPA, Appellant is BCCI thus is a legal entity and is registered under the Registration Act XXI of 1860 at Madras. The Appellant controls the game of Cricket in India and also performs certain other functions including organization of Inter-State and other cricket tournaments including Ranji Trophy Tournaments, Col. C.K. Nayudu Tournament (Under 23). Prof. Ratnakar Shetty – General Manager – Admin and Game Development of the BCCI is the authorized person to contest the present appeal. That since the order impugned dated October 4, 2017 impugned in this appeal has the characteristic of a final order as due to the order impugned entire schedule of Col. C.K Nayudu Tournament which has already commenced has been disturbed, therefore, the order impugned is fully amenable to Appellate jurisdiction of this Court under Rule 12 of the Letters Patent Rules. The Appellant is not party-respondent in the writ petition OWP No. 1546/2017 titled Hisham Saleem verses State of J&K and others, but the order dated October 4, 2017 passed by Single Judge is adversely affecting the Col. C.K. Nayudu Tournament (under 23) therefore, is filing the instant appeal against the aforesaid. A separate application seeking permission to file LPA is also being filed. The Appellant has organized a national level cricket Tournament namely C.K. Nayudu Trophy (under 23). The said tournament has commenced in first week of October 2017 and final match is scheduled for December 17, 2017. The 1st match of the cricket team representing JKCA in the Col. C.K. Nayudu Tournament (Under 23) was scheduled for October 8, 2017 but due to aforesaid order, the match has been cancelled and 2nd match is scheduled to commence on October 15, 2017 followed by other matches.
