JAMMU: City Judge Jammu M.S Manhas on Tuesday directed Inspector General of Police (IGP) Jammu to proceed ahead in terms of Section 156(3) Cr.PC and constitute a Special Investigation Team (SIT) to probe allegations leveled by a woman against SHO Kanachak Rakesh Sharma and others.
Meanwhile, SHO Kanachack Inspector Rakesh Sharma has been attached to District Police Lines (DPL) Jammu while Inspector Naresh Sharma from SOG Jammu has been posted as SHO Kanachak.
Justice Manhas, after hearing battery of lawyers, observed that the allegations are of very serious nature and need to be investigated thoroughly so that the truth comes out and justice should be imparted to both the parties and whosoever found guilty should face the consequences of law.
While directing the IGP Jammu to constitute SIT, the court recommended five names of police officers to be the part of SIT for investigating the matter. These include Basant Kumar Rath DIG, Mohan Lal Kaith SP, Vinod Kumar SP, Sandeep Choudhary SP, Sanjeev Bhasin SP and Dalip Kumar SP.
The Court directed IG Jammu to constitute team of at least three officers out of the five recommended police officers and directed to submit the compliance report within 15 days.
The Court further observed that another application has been filed today on behalf of the applicant stating that the hospital authorities be directed to provide medical treatment to the victim till she recovers fully. “In view of the submission made, IGP, Jammu is required to ensure proper medical treatment of the applicant”, the court observed.
The 25-year-old woman has alleged that she had been subjected to horrific torture by police after her arrest. The police, she said, stripped her and inserted beer bottle and chilli powder in her private parts. SHO Kanchak, she said, had been one of the perpetrators.
The police say the woman was arrested for theft and an investigation has been ordered into the matter. The woman, who worked as a domestic help, was arrested on April 30. Her employers had accused her of stealing gold ornaments.
“During investigation, some gold ornaments were recovered, police said. The woman was arrested and “kept in police lock-up under the guard of women police personnel”.
Activists say the police violated the law by not shifting her to the women’s wing immediately after the arrest. “A woman can’t be kept in a police station. It is a total violation of the law”, they said.
