Jammu: After victimization of Prof. Nutan Resutra Chairman J&K Board of Secondary Education, Dy. Superintendent of Police Vishal Shoore has been punished in terms of demotion by one rank. While Prof. Resutra was punished only for being a Jammuite and from minority, as published by STATE TIMES in its issue dated 7th February 2015, titled ‘Give Resutra a bad name and hang him-he is Jammuite!’, Vishal Shoore has been punished after the so-called departmental enquiry proved charges against him. On the contrary, Resutra was punished due to pressure built by a lobby from majority community, which did not like a person from minority and that too from Jammu to become Chairman of JKBOSE, despite selection by a committee constituted by the government and approval by none other than the Chief Minister, who appointed a candidate from Jammu after 23 years.
There are numerous instances of favouritism. If a candidate belongs to majority community and that too from the Valley the chances are brighter, as the government needs no logic or rules to favour him.
Fareed Ahmed Choudhry, presently posted as Superintendent Engineer PHE (Rural) Jammu is one of such example of favourtism. Fareed Ahmed joined the service as Assistant Engineer through selection made by the Public Service Commission on 16th May 2000 and was promoted as Assistant Executive Engineer in just 14 days on 1st June 2000 in gross violation of the Engineering Gazetted Service Rules which envisage that a person with at-least three years service can be promoted from A.E to A.E.E. Enormity of favouritism can be gauged from the fact that Fareed was given seniority from 1988. What can be cruel joke than this that an employee is given benefit of seniority for a period when he was not in the government service at all?
As if it was not enough, Fareed was promoted as Executive Engineer vide Govt. order No.379 PW-R&B dated 22-9-2006 though he was due for promotion from AEE to Executive Engineer in 2009. The favour was done despite the fact that the engineer had been blessed with out of way promotion earlier in just 14 days of joining the government service.
The story of favouritism does not end here. Fareed Choudhry was placed as I/C Superintendent Engineer, vide Govt. Order No.122 PW(R&B) of 2008 dated 8-6-2008, in shortest span of just nine years of service which otherwise as per Engineering Gazetted Service Rules needed 17 years to reach this level.
Aggrieved over repeated promotions to the blue eyed engineer, some of the colleagues of Fareed made numerous representations to the government for justice but each time files were either ‘found misplaced’ or stolen, said an aggrieved engineer on assurance of anonymity.
Ultimately R.T.I. Act came to the rescue/support of aggrieved and on 7 August 2012 the Government vide Order No: PW(R&B)PIO/RTI/98/2012 provided the detailed information about dramatic rise of Fareed Choudhry in his engineering career. Interestingly, the information confirmed that the Chief Minister Omar Abdullah had approved, under his signatures on 15th July 12, the observations that “SH.FAREED DOES NOT HAVE THE REQUISITE LENGTH OF 20 YEARS SERVICE IN GAZETTED CADRE,WHICH IS MANDATORY IN TERMS OF S.R.O DATED 14TH SEPT-2008”. Despite this, Fareed Choudhry is being tipped for the post of Chief Engineer, which his colleagues apprehend will be ordered shortly.
One of the engineering colleagues of Fareed quoted the morale of an old story ‘Wolf and the Lamb’ that “WHEN A WICKED PERSON WANTS TO GET A THING, HE NEEDS NO EXCUSE” and for a person of majority community and that too from the Valley there is no need of rules to favour, just as there is no requirement of rules to punish an educationist like Prof.Nutan for only fault that he is from minority and from Jammu.
The Kashmir centric government is not only selective in bestowing favour. When it comes to shielding any officer of the majority community, the government can go to any extent. This was proved beyond doubt in the case of Baseer Ahmed Khan, who despite having warrants in a heinous corruption case, enjoyed coveted postings due to tacit understanding of the government. Charges against Baseer Khan, among others, were established in the high profile case FIR No: 8 of 2009 VOJ, related to the infamous Gulmarg Land Scandal.
In similar other instance, one G. M. Khwaja ex-Deputy Commissioner Baramulla was allowed to continue in service despite the fact that a case of tampering of date of birth was proved against him. The gentleman enjoyed not only the service but had all the benefits of retirement without any action having been taken against him, as he belonged to the Valley. These are not the only cases of favourtism to the Valley employees viz-viz Jammu, but who cares in popular government dominated by the valley, but at-least justice is expected during the Governor’s Rule.
