JAMMU: Special Municipal Magistrate Jammu Manoj Parihar awarded 2 years imprisonment to Rajinder Kumar, tractor driver for killing a pedestrian.
According to police case, on October 7, 2008 a report was received from the reliable sources that one Tractor bearing No. JK02F/3912 driven by accused so rashly and negligently, was coming from Gole Pulli towards Poonch House at 4:30 PM near Ganda Nallah Main Road Talab Tillo and the accused could not kept the control on the Tractor, caused accident with one person Madan Lal, who got injured and was admitted to GMC, Jammu, the injured succumbed to his injury. The investigation was ensued. After investigation offence under Sections 279 and 304-A RPC were proved against the accused.
After hearing Advocate Kunal Chib for the accused whereas Prosecuting Officer Altaf Wahid for the State, the court observed that the charge against the accused is found to be proved by the prosecution beyond reasonable doubt as such, the accused is found guilty in offence under aforesaid Sections 279/304-A RPC and accordingly is convicted and sentenced to undergo simple imprisonment for six months under Section 279 RPC and two years under Section 304-A RPC. These two sentences shall run concurrently.
